Overseas Citizen of India (OCI) Card

The Overseas Citizenship of India (OCI) Scheme for registration of Persons of Indian Origin (PIOs) as Overseas Citizen of India (OCI) was introduced by amending the Citizenship Act, 1955 in August 2005. OCI Card holders are entitled to multy-entry, multi-purpose life-long visa to visit India, exemption from registering with FRRO for any length of stay in India, parity with NRIs in financial, economic and educational fields except for acquisition of agricultural or plantation properties.

The OCI Scheme was modified on 9 January 2015 by further amending the Citizenship Act, 1955 and the earlier scheme for issuance of PIO Card was merged with the OCI Scheme.

PIO Card Validity Extended up to December 31, 2024

The Indian Immigration will accept all Person of Indian Origin (PIO) cards (including handwritten PIO cards), along with valid foreign passport, as valid travel document till December 31, 2024, instead of earlier deadline i.e. December 31, 2023. Indian Immigration Check Post(s) will continue to consider all PIO card valid for exit from/entry into India till December 31, 2024 as last and final opportunity. This extension of timeline is subject to the condition that if in the meantime, any deadline is notified by the International Civil Aviation Organization (ICAO) thereby making handwritten PIO cards invalid, then PIO cardholders may have to obtain appropriate visa from Indian Missions/Posts. It may, however, be ensured that the PIO card is valid at the time of travel.
All PIO cardholders (handwritten and machine-readable) are meanwhile advised to convert their PIO card to OCI card. With effect from 9 January 2015, PIO Card Scheme has been withdrawn and all existing PIO card holders are deemed to be Overseas Citizens of India (OCI) card holders. The PIO Card holders must obtain an OCI card in lieu of their PIO card by applying online at https://ociservices.gov.in/

Revised guidelines for re-issuance of OCI cards (Effective from 19.04.2021)

(i) Mandatory requirement of re-issuance of an OCI card each time a new passport is issued to a foreigner upto 20 years of age and once after completing 50 years of age is dispensed with.

(ii) OCI cardholder is required to get the OCI card re-issued only once when a new passport is issued after completing 20 years of age.

(iii) OCI cardholder is required to upload ONLINE a copy of the new passport and a latest photo each time a new passport is issued upto 20 years of age and once after completing 50 years of age. The uploading of these documents may be done within three months of receipt of the new passport. The service will be provided on gratis basis.

(iv) Foreign Spouse of an Indian Citizen or spouse of foreign origin of an OCI cardholder are required to upload a copy of the new passport and also a latest photo ONLINE each time a new passport is issued along with a declaration on subsisting of marriage, copy of the Indian passport of the Indian spouse/passport & OCI card of the OCI cardholder spouse.

(v)Further, on account of the on-going COVID-19 pandemic, in order to avoid inconvenience to OCI cardholders who are required to get their OCI cards re-issued, it has been decided by the Government of India to extend the timeline for re-issuance of OCI card from December 31, 2021 till December 31, 2022.

(vi) The requirement of carrying old and new passports, along with the OCI card, has been done away with. Henceforth, an OCI cardholder traveling on the strength of existing OCI card bearing old passport number is not required to carry the old passport. However, carrying the new (current) passport is mandatory.

Eligibility for registration as OCI-

As per Section 7A of the Ordinance, the following categories of persons may be registered as Overseas Citizen of India cardholder:

(a) any person of full age and capacity,

(i) who is a citizen of another country, but was a citizen of - India at the time of, or at any time after, the commencement of the Constitution; or

(ii) who is a citizen of another country, but was eligible to become a citizen of India at the time of the commencement of the Constitution; or
(iii) who is a citizen of another country, but belonged to a territory that became part of India after the 15th day of August,1947; or
(iv) who is a child or a grand-child or a great grandchild of such a citizen; or

(b) a person, who is a minor child of a person mentioned in clause(a); or

(c) a person, who is a minor child, and whose both parents are citizens of India or one of the parents is a citizen of India; or

(d) spouse of foreign origin of a citizen of India or spouse of foreign origin of an Overseas Citizen of India cardholder registered under section 7A and whose marriage has been registered and subsisted for a continuous period of not less than two years immediately preceding the presentation of the application under this section: Provided that for the eligibility for registration as Overseas Citizen of India cardholder, such spouse shall be subject to prior security clearance from a competent authority in India. Provided further that no person, who is or had been a citizen of Pakistan, Bangladesh or such other country as the Central Government may, by notification in the Official Gazette, specify, shall be eligible for registration as Overseas Citizen of India cardholder.

 

The OCI Card holder is NOT entitled to the following:
i. to vote, 
ii. to be a member of a Legislative Assembly or Legislative Council or the Parliament of India, 
iii. to hold Indian constitutional posts such as that of the President, Vice President, Judge of the Supreme Court or High Court etc.
iv. He/she cannot normally hold employment in the Government,
v. The OCI Card does not entitle the holder to undertake any missionary work, mountaineering or research work, without prior permission.

Application for registration for issue of an OCI card has to be made online at https://ociservices.gov.in/ 

Application form with self-attested copies of all documents and prescribed fees has to be deposited in the Consular Section in the Embassy.

1. OCI application form duly filled up, signed and pasted with photo.

2. Copy of Foreign passport of applicant.

3. Copy of Certificate of Acquisition of Foreign Nationality.

4. Copy of cancelled Indian passport containing personal particulars and passport officer´s observation (s) if any.

5. Renunciation Certificate issued by Embassy. (Refer under Miscellaneous Consular Services for Renunciation Certificate).

6. Copy of previous Indian visa if any.

7. Copy of proof of residential address in Mexico i.e. electricity, water, telephone bill in the name of applicant or any family member or Copy of a lease deed /rent agreement with a copy of landlord’s Mexican ID.

8. Original Letter of Employer in English, signed by the authorized signing authority of the company addressed to the Consular Officer, Embassy of India, Mexico City, stating date of appointment and position in the Company. In case of private business, copy of Company’s Registration with SAT.

4. Copy of Marriage Certificate of parents duly apostilled.

5. Copy of Indian Passport [with the Mexican Residency (FM) card] / OCI card of the parents/ grandparents.

6. Copy of previous Indian visa if any.

7. Copy of proof of residential address in Mexico i.e. electricity, water, telephone bill in the name of applicant or any family member or Copy of a lease deed /rent agreement with a copy of landlord’s Mexican ID.

8. Original Letter of Employer in English, signed by the authorized signing authority of the company addressed to the Consular Officer, Embassy of India, Mexico City, stating date of appointment and position in the Company. In case of private business, copy of Company’s Registration with SAT.
